DELTA-DELFINI & CIA. S.A., is a legally constituted company in Ecuador, identified with Taxpayer Unique Registry No. 0990007721001, whose contact details are via email: delta@deltadelfini.com; phone number 04-605-5000, and with the address at Av. Miguel H. Alcivar and intersection V.H. Sicouret and N. Isaias, in the city of Guayaquil, Ecuador (collectively, “DELTA”, “it”, “its”, “we” “us” or “our”).

DELTA, in compliance with the laws and regulations, hereby informs through this document how DELTA processes the personal data of its clients and users in its different stages, obtained from public or authorized sources of information, as well as those collected through its own or associated electronic channels.

DELTA defines a USER as anyone who accesses the DELTA website. The DELTA website has not been designed, developed, neither contains nor runs programs that induce a person to enter an electronic address different from the one the user intends to enter. Likewise, this website does not aim to collect personal information from its users, except for the creation of a database of people who wish to download our catalogs for the actions expressly listed in this privacy and personal data protection policy.

In accordance with the provisions of article 8 and other provisions of the Data Protection Law, as well as secondary legislation on the subject (Law on Electronic Commerce, Electronic Signatures, and Data Messages; Constitution of the Republic of Ecuador), we inform that by entering data on this portal, a user gives free, specific, informed, and unequivocal consent for the processing of personal data for the purpose of receiving emails, calls, text messages, or notifications from DELTA, regarding the commercial activity it carries out and the products it markets, and that the personal data you have provided, as a user, will be part of the database to be used solely for the following purposes:

  1. Creation a database of DELTA’s clients
  2. Storage of information of USERS who access DELTA’s portal.
  3. Contact with registered USERS to commercialize DELTA’s products.
  4. Send advertising, commercial, and promotional communications about our products and services.
 

1.- ABOUT THE INFORMATION COLLECTED BY DELTA

The data that users provide when using this portal may be subject to storage in DELTA’s databases. The processing of personal data will be carried out in accordance with Article 4 of the Law on Personal Data Protection and may be carried out by DELTA only for the purposes authorized by the user and/or for the purposes contained in this policy. DELTA will give the USER the possibility to accept receiving emails from third parties with whom we have commercial relationships, along with information about the entities that will be responsible for their data and the purposes for which they will use them, only by maintaining the website subscription.

 

2.- USER RIGHTS AND WITHDRAWAL OF CONSENT

DELTA users will have and may exercise the following rights regarding their information as contemplated in the Law on Personal Data Protection:

  • Right to information,
  • Right of access,
  • Right of rectification and updating,
  • Right to deletion, right to object,
  • Right to portability,
  • Right to suspend processing.

 

The exercise of these rights will be attended to as long as they do not fall within the exceptions provided in Article 18 of the Law on Personal Data Protection. DELTA users may at any time withdraw the consent granted at the time of entering and submitting personal data through our digital portal, in accordance with Article 8 of the Law on Personal Data Protection. For this purpose, DELTA has a simple, efficient, effective, and free system by which users can withdraw their consent and thus the processing of their personal data will cease, emphasizing that any processing prior to the withdrawal of consent is lawful under the previously mentioned article. 

 

3.- SECURITY

DELTA uses appropriate and necessary security methods to protect the data on its servers, thus complying with the principle of personal data security contemplated in the Law on Personal Data Protection. However, no security system is impregnable; therefore, DELTA cannot guarantee the security of the servers. It is also possible that the information provided to us may be intercepted during data transmission.

 

For the protection of the information that USERS provide to DELTA, we will take reasonable and appropriate measures to protect it. In the event of any contingency with the processed information, the user will be notified and actions will be taken in accordance with the Law on Personal Data Protection. As described in this privacy and data protection policy, DELTA will not disclose, share, sell, borrow or rent personal information collected on the website to third parties for promotional use without prior consent.

 

In the event that DELTA proceeds with the sale or transfer of part -or all- of its business or assets to another organization, such as in a merger and acquisition operation, or in the event of bankruptcy, dissolution, or liquidation, the personal information of our customers such as their name, email address, and any other information collected through the website or our service, may be one of the items sold or transferred. The resulting buyer -or the absorbing or acquiring company- will comply with the commitments made in this privacy and data protection policy.

 

 

4.- SUBSCRIPTIONS

Users can edit or delete their information from DELTA’s database subscription, for which they must contact us, or it can be done by deleting or modifying the content or other data they have provided.

 

5.- CHANGES TO DELTA’S DATA PROTECTION POLICY

DELTA may modify this policy when appropriate and at any moment. The modifications will be effective after DELTA publishes the updated policies through the communication media used by the company, which may include -but are not limited to- social media, website publications, email notifications, among others. Accessing to our portal after such publication provides consent and acceptance of the policies and their modifications.

 

By accepting this policy, the user expressly and irrevocably waives any action of any nature, whether in judicial or administrative proceedings against DELTA. The user may stop using this portal at any time and request not to receive any information in their email.
